These Terms of Service (the Terms) are a binding agreement between you and EventQuestor, operated by [Legal Entity Name] (EventQuestor, we, us, or our), and govern your use of the EventQuestor website and scavenger hunt service (the Service). Please also review our Privacy Policy.
Please read Section 18 carefully.
It requires most disputes to be resolved by binding individual arbitration and waives the right to a jury trial and to class actions. You may opt out of arbitration within 30 days.
1. Acceptance and eligibility
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
To create a host account you must be at least 18 years old and able to form a binding contract. Players may be younger than 18 when they join a hunt through a host, but a host who invites minors is responsible for supervising them and, where the players are under 13, for obtaining verifiable parental or guardian consent as described in our Privacy Policy. If you use the Service for an organization, you represent that you are authorized to bind that organization to these Terms.
2. The service
EventQuestor is a no-install web application that lets a host describe a theme and location, generate a scavenger hunt with AI-assisted missions, and run that hunt for players who join from a mobile browser using a link or QR code. Missions may include text, photo, GPS, and multiple-choice tasks. We may add, change, or remove features over time.
3. Accounts and registration
Hosts sign in with an email address. You are responsible for the accuracy of your account information, for all activity that occurs under your account, and for keeping your sign-in access secure. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.
4. Plans, billing, and payments
The Service offers the following plans. All prices are in US dollars and are processed by our payment processor, Stripe.
- Free pilot. Each account is entitled to one free experience for the lifetime of the account. The free experience may be used at any time, including before or after a paid plan, but it can only be used once. Once the free experience has been used, it is not available again, and the account remains on the Free pilot until a paid plan is purchased. The Free pilot is limited to a small group of players and a reduced mission count.
- Single Experience plans. Discovery 5, Explorer 15, Expedition 25, and Summit 50 are one-time purchases. Each purchase grants one experience with a defined participant capacity and a 14-day access window that begins at the time of purchase.
- QuestOps subscription. QuestOps is a recurring subscription billed monthly or annually that allows repeat experiences at a higher participant capacity while the subscription is active.
When a paid plan ends — for example, when a Single Experience access window closes or a QuestOps subscription is cancelled or lapses — your account returns to the Free pilot. If you have already used your one free experience, no additional free experience becomes available. Experiences you already created are not retroactively removed, but creating new experiences will require an available entitlement or a new purchase.
You authorize us and our payment processor to charge the payment method you provide for the plan you select, plus any applicable taxes. You are responsible for keeping your payment information current.
5. Auto-renewal and cancellation
The QuestOps subscription automatically renews until you cancel it. At the end of each billing period — monthly or annual, depending on the option you chose — the subscription renews for another period of the same length, and your payment method is charged the then-current price for that period. Single Experience plans are one-time purchases and do not automatically renew.
You may cancel a QuestOps subscription at any time through the billing portal available from your dashboard. Cancellation stops future renewals. Your subscription access continues until the end of the billing period that has already been paid, and you are not charged again after cancellation. We may notify you before an annual renewal as required by applicable law, including the California Automatic Renewal Law.
6. Refunds
Except where required by law, payments are non-refundable. Single Experience purchases are non-refundable once the access window has begun. Subscription charges already incurred are non-refundable, and we do not provide partial-period refunds when a subscription is cancelled. If we issue a refund for a one-time purchase, the related experience may be downgraded to the Free pilot tier. If you believe you were charged in error, contact us using the details in Section 22.
7. Host responsibilities
As a host, you agree to:
- Choose safe, lawful, and publicly accessible locations for missions.
- Review and edit every AI-generated mission before publishing a hunt.
- Supervise players, especially minors, and end a hunt if conditions become unsafe.
- Obtain any consent required to invite players, including parental or guardian consent for players under 13.
- Comply with all laws and venue rules that apply to your event.
You are solely responsible for the hunts you create and run and for the conduct of your event.
8. Assumption of risk and release
A scavenger hunt is a real-world activity that takes place in physical locations. Participation involves inherent risks, including travel, movement through public and private spaces, interaction with other people, weather, and other conditions outside of our control. To the fullest extent permitted by law, you voluntarily assume all such risks for yourself and for any minor you supervise.
EventQuestor does not select event locations, supervise events, or control participant behavior. To the fullest extent permitted by law, you release EventQuestor from claims for injury, loss, or damage arising out of participation in a hunt, your interaction with locations or other people, or the conduct of a host or other participants. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Acceptable use
You agree not to use the Service to:
- Trespass, enter unsafe areas, cross dangerous roads, or break any law.
- Harass, threaten, endanger, or harm any person.
- Submit or generate content that is illegal, hateful, harassing, explicit, or that violates the privacy or rights of others.
- Upload another person personal information without their permission.
- Interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.
- Reverse engineer the Service or use it to build a competing product, except as permitted by law.
- Misuse AI generation, automate abusive requests, or attempt to bypass plan limits or rate limits.
10. User content and license
You and your players may submit content such as themes, mission text, photos, and answers (User Content). You retain ownership of your User Content. You grant EventQuestor a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit User Content solely to operate, secure, and improve the Service. You represent that you have the rights needed to submit your User Content and to grant this license.
11. AI-generated content
The Service uses third-party AI providers to generate hunt missions. AI-generated content may be inaccurate, incomplete, unsafe, or inappropriate for a particular group or location. We do not guarantee its accuracy or suitability. Hosts must review and edit AI-generated missions before publishing, and hosts are responsible for the missions they choose to publish.
12. Intellectual property
The Service, including its software, design, text, and logos, and all related intellectual property, is owned by EventQuestor or its licensors and is protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
13. Third-party services
The Service relies on third-party providers, including those listed in our Privacy Policy, and may link to third-party content. We are not responsible for third-party services or content, and your use of them may be subject to their own terms and policies.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EVENTQUESTOR AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO EVENTQUESTOR IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
16. Indemnification
You agree to indemnify and hold harmless EventQuestor and its owners, employees, and suppliers from and against any claims, losses, liabilities, and expenses, including reasonable attorney fees, arising out of or related to your use of the Service, the hunts you create or run, your User Content, your violation of these Terms, or your violation of any law or the rights of another person.
17. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or to protect the Service or its users. On termination, the licenses granted to you end. Sections that by their nature should survive termination, including Sections 8, 10 through 16, and 18 through 21, will survive.
18. Dispute resolution and arbitration
Please read this section carefully. It affects how disputes with EventQuestor are resolved.
Binding individual arbitration. Except for the matters described below, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration on an individual basis, administered by a recognized arbitration provider under its consumer arbitration rules. The arbitration will take place in the county of your residence or another mutually agreed location, and judgment on the award may be entered in any court with jurisdiction. You and EventQuestor each waive the right to a jury trial.
Class action waiver. Disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person claims or preside over any form of class proceeding.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
30-day right to opt out. You may opt out of this arbitration agreement by emailing info@eventquestor.com within 30 days after you first accept these Terms, stating your name and a clear request to opt out of arbitration. If you opt out, disputes will be resolved in court as described in Section 19, and the class action waiver will not apply to you.
19. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-laws rules. The Federal Arbitration Act governs the interpretation and enforcement of Section 18. To the extent a dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in California, and you and EventQuestor consent to the personal jurisdiction of those courts.
20. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms. If you do not agree to the changes, stop using the Service.
21. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and EventQuestor regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
